1.REGARDING THESE TERMS OF USE

Moreover, any words that come after these terms are just examples and do not limit the meaning of the words before them. These rules were written in English. The rules in English will still apply, even if they are translated into other languages. If there is any disagreement, the following will be more important: (i) the rules that apply to your area, if there are any; (ii) the particular rules for the situation, if there are any; and (iii) the rest of the terms in these Terms of Use.
3.AGREE TO THESE TERMS OF USE
3.1 It is very important that you read and understand all the terms in the Terms of Use before downloading, using, or creating an account with us, as we often make changes to them. The rules will govern how you use the app and your account.
3.2 After you download the app, you need to make sure that you have read, understood, and agreed to the Terms of Use. By clicking "Accept" on Our System, you agree to these Terms of Use.
3.3 By downloading the app and making an account, you agree to the terms and conditions for using the account. Also, you recognize that these conditions do not impact any other legal rights or benefits we may have regarding the account.
3.4 These rules can be changed at any time. By using the service, you agree to any changes we make. We will do our best to keep you updated about any changes.
3.5 Sometimes, the website might release new updates for the app. You might not be able to use the Service until you update the App to the latest version and accept the new terms and conditions.
3.6 By using the App or any of the Services, you agree to allow us to gather and use technical details about your Mobile Device, such as its hardware, software, and accessories, for internet or wireless services. This information is used to improve our services and provide the services you asked for. By using these services, you agree that we, our partners, and authorized individuals can collect, store, process, and use your information to enhance your experience with the app and our service.
3.7 If we can't reach you in other ways or if you haven't paid the loan, we may contact you and the person you listed as your emergency contact to confirm your details.
4. WHAT YOU NEED TO DO AND WHAT YOU PROMISE
By signing this paper, you confirm and promise that:
4.1 You are completely capable and allowed to agree to these Terms of Use, to be legally obligated by them, and to meet your duties as stated in them.
4.2 You promise to quickly tell us about any breaches of these agreements and to follow these rules and all applicable laws very carefully.
4.3 You understand that the System and the Service should only be used for valid reasons and as they are meant to be used.
4.4 You must make sure that any personal information, certificates, or papers you or your representatives give us are correct, full, honest, and current.
4.5 You need a confirmed account and internet connection.
4.6 You are not allowed to be dishonest, deceive, or lie.
4.7 The system works smoothly when the network is not blocked or bypassed.
5. HOW DO YOU UTILIZE THE SERVICE?
5.1 Our service is only for people who are at least eighteen years old.
5.2 The app will let you know that your account request has been accepted. By agreeing to this, you understand that the acceptance of your account application does not create any legal connection between you and the third party.
5.3 We can refuse or cancel your loan request at any time without giving a reason, based on our own judgment.
5.4 We can decide to approve, reject, or change the terms of a loan by looking at your credit history. The app will show the interest and the terms of the loan application.
6. THE WAYS YOU USE TO ESTABLISH THE SYSTEM ALLOW PRIVILEGES AND LIMITATIONS
6.1 During the time you agree to these rules, we give you permission to use the system for your personal use to access the services we offer.
6.2 We keep all rights that are not specifically given to you in these Terms of Use. These rules do not give you ownership of the System, either completely or partially.
6.3 The following activities are not allowed when using the System:
6.3.1 Allow others to use, share, sell, transfer, or distribute the System for business reasons.
6.3.2 Section 6.3.2 Use reverse engineering to access the inner workings of the software, make changes to the system, or create new projects inspired by it.
6.3.3 Copying the system to make a similar product, using its ideas or features, or sending too many requests that could make it slow down is not allowed. Also, trying to enter the system or other systems or networks without permission.
6.3.4 Using any software or technique to view, arrange, or duplicate the System's layout, look, or data.
6.3.5 The System cannot delete any copyright, trademark, or other ownership notices without the owner's permission. Moreover, it is not allowed to share or copy any protected material, brand names, or other private information without permission.
6.3.6 Spread or keep any information for deceitful or dishonest reasons.
6.3.7 Sending messages that are not wanted, like spam, or causing trouble, disturbance, or making fake reservations in any way is not allowed.
6.3.8 Do not share or keep content that is illegal, offensive, or harmful.
6.3.9 Sending harmful computer viruses, worms, or trojan horses is not allowed.
6.3.10 Disturb or harm the system's ability to work properly or the data it holds.
6.3.11 Incorrectly claim that a person or group is connected to another.
6.3.12 Intentionally misrepresenting one's whereabouts.
6.3.13 Information that could affect our decision to do business with you is not being presented accurately.
6.3.14 In any way, could harm our reputation or the reputation of any companies we are connected to.
6.3.15 Try to understand any messages sent to or from the servers that host our services, or gather any information from our systems or services.
7.YOUR DETAILS
You agree to let your personal information be used following the Privacy Policy, which might change occasionally.
8.REQUESTS YOU MAKE
8.1 You give us permission to handle any requests you make through the system, and you are responsible for what happens as a result of your actions.
8.2 We can say no to your loan request, even if we have approved a loan for you before.
8.3 We can handle any request, even if it's not very clear or complete, as long as we think we can figure out any uncertainties without needing more information from you.
8.4 If we believe the instructions came from you, you must follow any request we make. We will consider that we have met all our responsibilities to you, even if the request was a mistake or done dishonestly.
8.5 We can wait to work on your request until we get more information or confirmation from you.
8.6 By agreeing to this, you allow us to release ourselves from any responsibility for any problems that may arise from us following or not following your requests.
8.7 You agree that we are not responsible for any unauthorized actions on your account if you share your account information, like your PIN, password, or ID, with someone else. This applies even if the mistake was made by you, as allowed by the law.
8.8 We can take any needed actions on your account as instructed by a court, authority, or agency following the law.
8.9 These rules will be followed if there is a difference between what is written here and what you ask for.
9. SOME TASKS ARE YOUR RESPONSIBILITY
9.1 It is your job to make sure your phone is safe and works well. It is very important that the system and service work well, and you are in charge of any costs related to them.
9.2 It is your job to make sure your phone works correctly. We are not responsible for any mistakes or problems that may happen if your phone stops working. This includes computer viruses or other problems that may happen when using our system, service, or mobile device. If the company that gives you internet has any problems that make you wait or lose something, we are not responsible. Instead, you will be responsible for any charges that the service provider may apply.
9.3 The app will be available on your phone. It is very important to make sure that the right app is installed on your device. We are not responsible if your device doesn't work with the app or if you don't have the latest version installed on your phone.
9.4 If you lose your phone, it gets stolen, damaged, or you can't use it anymore, you must tell us right away and follow our directions. This could put our legal rights at risk or expose your account information to someone who should not have it. If someone finds out your account information and login details, you agree to protect Us from any possible losses. Also, you promise not to blame us. We are not responsible if this information is shared with someone else.
9.5 You are responsible for choosing and paying for a suitable internet and phone plan, which includes fees for messages, internet usage, and phone data from your mobile provider. It's important to know that the system might need a lot of data, and you will be responsible for using it and any costs that come with it.
9.6 It is your job to follow the rules and instructions in the Terms of Use and any other documents we give you when using the System and the Service.
9.7 It is very important that you do everything necessary to stop people from using the Service and System without permission. To do this, make sure you or someone you trust quickly check every message we send to spot any unauthorized system use. You must quickly inform us if:
9.7.1 You might have a good reason to believe that someone who is not allowed to see your registration information has or may have it.
9.7.2 You suspect that a transaction might be fake or not secure, and that someone is using the service without permission.
9.7.3 It is very important that you follow the security rules we give you regularly, as well as any other rules that are relevant to the service. You should follow the security rules to avoid sharing your account details. You must make sure that only the right people can use the service and that no one else can make requests or do important things.
10. INFORMATION ABOUT YOU
10.1 To use the System, you need to create and keep an account as an App user.
10.2 You are in charge of everything related to your account.
10.2.1 It is important to create a clear account.
10.2.2 You are responsible for keeping your account information private and secure.
10.2.3 You are not allowed to give anyone else access to your account or share its contents with someone else.
10.2.4 If you think someone has used your account without permission, please let us know right away.
10.3 We can limit or stop your account access and turn off app features without giving up any of our other rights or solutions.
10.3.1 If we find out on our own that you have broken any of these rules;
10.3.2 During the inquiry;
10.3.3 If you owe us or any related companies money for any reason, such as the main amount, interest, fees, or taxes;
10.3.4 If these rules are canceled for any reason.
10.3.5 At any other moment, as long as we are happy with the result.
11. PAYMENT CONDITIONS
Fees for borrowing money and charges for services
11.1 You must pay all the money you owe according to these rules, without making any deductions or claims, unless the law says otherwise. If you need to take out money from a payment you send us, you must then send the extra amount to make sure we get the full payment without any deductions or withholdings.
11.2 If you don't pay back a loan to us on time, we might charge you an extra fee.
Taxes
11.3 You must pay certain amounts as stated in these Terms of Use and Loan, but taxes are not included in those amounts. Moreover, you will need to pay an extra amount equal to the payment times the tax rate if taxes are due on the payment. Even if our relationship ends, you must still follow our requests and make the payment.
11.4 By agreeing to this contract, you allow us to keep money from your account if needed by law, as agreed with tax authorities, or to follow internal rules, directives, or sanctions from tax authorities.
Regarding money
11.5 You agree to pay back the loan, including interest, fees, and taxes, using the payment options in the app by the deadline.
11.6 All payments must be made using the currency of the area.
12.AUTOMATICALLY
12.1 A default event occurs when you
12.1.1 If you don't pay what you owe for a loan from these Terms of Use within fifteen (15) days, except in cases of administrative error, technical problem, or insolvency.
12.2 We can take action at any time if there is a problem, in addition to other rights we may have under the law.
12.2.1 These Terms of Use will end as stated in the relevant section.
12.2.2 Show that the money borrowed needs to be paid back right away. This includes any remaining interest, charges, taxes, or other payments that are still owed based on these conditions.
12.2.3 If the payment is late, an extra charge will be added to the bill.
13. LENGTH OF TIME AND CONCLUSION
13.1 These rules will stay in place until they are ended as stated in their conditions.
13.2 We can stop your access to the System, the Service, and your Account according to these Terms of Use.
13.2.1 by giving you information whenever you need it and for any reason.
13.2.2 You must follow these rules right away, even if you are not told beforehand, without affecting our other rights and options.
13.2.3 If your mobile money company or mobile network provider ends your account or agreement for any cause;
13.2.4 Your account might be closed for a while or deleted permanently if changes or improvements need to be made to the service due to technical issues or safety reasons, or if you don't use your account for a long time.
13.2.5 If we are told to follow advice from a government agency, a court, a regulator, or another authority;
13.2.6 We will decide whether to stop the service for business or any other reason.
13.3 If these Terms of Use end or expire, you must:
13.3.1 You must quickly pay any money you owe, such as the loan amount, interest, fees, or taxes. This needs to be done within three days after it ends.
13.3.2 Delete the app from your phone right away.
13.4 However, ending the agreement will not change any rights or duties that have already been agreed upon by both parties.
13.5 After the Terms of Use end, both parties will not have any more responsibilities or privileges other than the ones they had before the termination. However, any other part of the agreement that is meant to stay valid will still be in force.
14.OFFERING COMPENSATION AND NOT HOLDING RESPONSIBLE
Payment for work done
14.1 You must protect and take responsibility for us, our partners, and their relatives from any harm, legal costs, or expenses that may arise from certain situations.
Breaking these rules or any other laws.
14.1.1 How you use the Service and/or the System.
14.1.2 Claims made by others because you used the service or system.
14.1.2.1 We are not responsible for any harm caused by using or having software from another company, like operating systems or web browsers.
14.1.2.2 If someone gets into your information without permission, if there are security problems, if you lose or damage your mobile devices, or if someone enters your account without permission.
14.1.2.3 We might lose money if you break these rules and cause us harm, like giving wrong information or not following the rules, or if other systems have problems.
Not responsible
14.2 We are not responsible for any losses you experience due to service interruptions caused by problems with your mobile devices or other factors beyond our control, like system errors, equipment failure, power outages, bad weather, or telecommunication system issues.
14.3 You understand that the app may not have been created specifically for your needs. It is your job to make sure that the App's features and functions are suitable for you as they are explained.
14.4 The app is only meant for personal use. We promise that we will not be responsible for any problems that may affect your business, missed chances, or money losses. The app is not meant to be used for business or selling.
14.5 You understand that we are not responsible for any losses or damages that may happen due to:
14.5.1 Any problem or flaw in the app or service caused by changes you made.Any problem or flaw in the app caused by not following the rules.
14.5.2 The particular rule that you broke.
14.5.3 Your account does not have enough money.
14.5.4 The money in your account is part of a legal disagreement that limits your ability to make payments or transfers. Your ability to send money may be affected if you do not give clear instructions for transactions or if there are problems with the system, your phone, the network, or a mobile money service.
14.5.5 Using the system, service, or your phone in a dishonest or prohibited way.
14.5.6 If you don't follow the rules and guidelines we've given you for using the system and the service.
14.6 We are not responsible for any additional or indirect losses or damages that may happen when using the Service, even if we were aware of the possibility.
14.7 The amount you paid us for the first event that led to a claim under these terms will not be more than our total responsibility for the app, the system, the service, and these terms. This restriction applies to the rules and conditions stated here, regardless of the legal basis for the argument.
14.8 You must inform us of any issues or complaints about the App, the System, the Service, or these Terms of Use within six months of when they happened, unless stated otherwise in these Terms of Use. If you don't take action, you won't have any rights or solutions for those problems as allowed by the law.
14.9 We want to make it clear that we are not responsible for:
14.9.1 The messages you send or the content you see on the App might be affected by communication problems that we cannot control.
14.9.2 If you have a problem receiving messages or content due to your mobile network, internet provider, browser, or software we don't manage, we are not responsible for any delays or losses.
14.9.3 Viruses that can harm your phone or other belongings when you use the app.
14.9.4 Using or checking any communication or data before it is sent from the App to our servers is not allowed.
14.9.5 If someone looks at your information or transactions without your permission, it's only allowed by law. We are not responsible for this unless we are negligent, careless, or break data protection laws.
14.9.6 Any additional material provided from outside sources.
15. ADDED NEW WEBSITES
15.1 Our service may have links to websites or apps from other companies. These links are meant to suggest helpful content for you. However, when we include links to other websites or apps, it doesn't mean we support or agree with the ideas, opinions, products, services, information, or other content found on those sites or apps.
15.2 We want to make it clear that we do not promise or claim that the information on other websites or apps is accurate, complete, reliable, or suitable for any specific use. We cannot ensure that websites or apps from other companies are safe from viruses or other problems, or that they do not violate copyright, trademark, or other rights.
15.3 You understand that other websites and apps might have different privacy rules and may not be as safe as ours. You can choose whether or not to check out or use any of the products or services offered on a website or app from a different company.
16. AGREEMENT TO RECEIVE MARKETING MESSAGES
By using our services, you agree to receive advertising messages from us. You can stop getting marketing messages from us anytime by clicking on the "unsubscribe" link in the message or following the instructions in the message.
17.SOLVING ARGUMENTS
17.1 Tanzanian laws will be used to control these rules and any disagreements that might happen, unless the law in your area says differently. In any other situation, these Terms of Use will be ruled by the laws of your area.
17.2 If there is a disagreement about these rules, it will be settled by a person chosen by both sides or within a week if they can't agree. This is correct, except for any rules that are clearly stated in this document. When someone applies, the Chairman of the Tanzania Arbitration Center will choose the arbitrator.
17.3 The Rules of Procedure will be used in Dodoma to decide the result.
17.4 Both parties must follow the arbitrator's decision as much as possible.
17.5 These rules do not stop either side from asking for quick help or temporary actions in court before the arbitrator makes a final decision.
18.IN CONCLUSION
18.1 We are not responsible if there is a problem or delay that is not our fault.
You promise not to share any secret information about our work, clients, or suppliers with anyone else.
18.2 You agree that we may transfer the loan rights to someone else without asking you first. The transfer mentioned does not change your responsibilities according to these terms. The payment methods listed in the app must be followed exactly.
18.3 We can change these Terms of Use whenever we want. We will do our best to let you know about any important changes to the Terms of Use. However, it is very important that you regularly check the Terms of Use. Any changes will be considered accepted as long as the System and the Service are still being used.
18.4 These Terms of Use allow both parties to use their rights as often as needed. They are not meant to replace any legal rights or solutions and must be formally rejected in writing. If a right is not used when needed or at all, it is not lost.

18.8 These rules do not apply to people who are not involved in following them.
